Because the Koi tribe plans to build a $600 million dollar casino in Sonoma County, a fierce debate has begun. The small tribe has no land but claims that its financial survival is impossible without a casino. The Khoi say casino construction is allowed under federal laws for “reclaimed lands.”
But their opponents, such as Governor Gavin Newsom, argue that the casino is not located on tribal land, therefore violating federal gambling laws. The final decision rests with the U.S. Secretary of the Interior.
The resulting dispute is not surprising because California’s tribal gambling market is the largest in the U.S. It includes 87 casinos, which bring in 8 billion dollars annually. One-fifth of America’s total number of recognized tribes is located in California.
76 tribes have ratified tribal gaming compacts with the state, of which 63 operate 66 casinos throughout California. Recently, a dispute between tribes and other gambling marketers in the state has come to light.

Under federal law, landless tribes are allowed to open casinos outside of their ancestral territories if they can prove their historical connection to the lands where they intend to build the casino. In 2019, a federal judge ruled that the Khoi Nation has the right to apply to purchase land for casinos. The basis for this decision was that the Khoi have been mistreated in the past and must now reclaim what they have lost. But they face significant opposition.
